Victim's Leave - Appointed Personnel
Definition
The purpose of Victim's Leave is to allow an employee, who is the victim of a crime, time off to be present at legal proceedings related to the crime.
Eligibility
- Any University employee is eligible for this leave except if a family member is the victim and the employee is in custody for the offense or is accused of the crime.
Procedure
Request for Victim's Leave is made to the employee's immediate supervisor or responsible administrator, providing as much notice as practical. In making this request, the employee shall provide:
- a copy of the form provided to employee by the law enforcement agency, and
- a copy of the notice of each scheduled proceeding that is provided to the victim by the responsible court or agency.
What Happens to Your Benefits?
- During paid status, deductions will be taken from your paycheck.
- During unpaid status, you may continue your health benefits for six months by paying both the employer and employee cost of any such benefits.
- Following the start of the unpaid leave date, you will receive in the mail a packet from the Leave Management Team of the Human Resources including:
- The form to waive, change or continue the existing benefits
- The bill with the itemized employee benefit cost and payment schedule
- Other helpful information
- Continuation of coverage after six months is available through the Consolidated Omnibus Budget Reconciliation Act (COBRA).
